Successful Damp & Mould Settlement
Aaron Murchan recently acted for a tenant who had been living in a property affected by persistent damp and mould, which had a serious impact on both their physical and mental wellbeing.
Despite repeated complaints, the housing association denied responsibility, attempting to attribute the problem to condensation allegedly caused by the tenant’s lifestyle. As a result, essential repairs were delayed and the conditions within the property continued to deteriorate.
Following instruction, Aaron gathered medical evidence, expert reports and photographic proof demonstrating that the damp and mould were caused by inadequate ventilation, rather than tenant behaviour. The evidence also supported the client’s claim for psychiatric injury linked to the living conditions.
Aaron secured a four-figure compensation settlement for the client in recognition of the impact the conditions had on their health and quality of life. The housing association also carried out remedial works, including the installation of additional ventilation, to address the underlying cause of the damp and mould.
