Damp and Mould Compensation Claims for Social Housing Tenants
What is a Damp and Mould Claim?
If you are Tenant within a NIHE property or a property owned by any Social Housing provider, as your Landlord they have certain obligations and duties to you under your Tenancy Agreement. If your home is hard to heat, bad at retaining heat, cold, damp or affected with black mould then it is likely that there are issues with your property and your landlord are responsible for repairing those.
What is the Process?
We work closely with Experts to assess your home and diagnose the problems. If our Expert confirms that there are issues with the property then you may be entitled to significant compensation.
What can I claim for?
1. If your home is covered with black mould causing property damage then we can reclaim the costs of this from the date you initially reported it to the NIHE or any maintenance officer i.e. damaged bedding, curtains, clothes, children’s toys, wallpaper etc.
2. Personal injury if a consultant confirms you or anybody in your home suffers from the following because of your living conditions:
- Asthma or other respiratory issues (i.e. COPD)
- Skin irritation dermatitis/eczema
- Psychiatric injury i.e. low moods or depression
- Circulatory issues owing to your cold home including strokes, ischaemic heart disease, myocardial infarction, hypothermia.
3. A Court Order or “Injunction” ordering the NIHE or your Landlord to fix the property and resolve the cold, damp and mould.

When determining the value of your claim, it’s essential to understand that each case is unique and fact-specific.
