Care Proceedings and Parental Rights in Northern Ireland: Dispelling Common Myths

A frequent concern raised by parents is the fear that entering care proceedings means losing all control over their child’s life. This is a misunderstanding that can add unnecessary anxiety at an already difficult time.

Do parents lose parental responsibility?

Even when a Care Order is made, parents retain parental responsibility. While the Trust may take the lead in decision-making, parents should still be consulted on important matters, where appropriate.

The role of the wider family

Northern Ireland courts are required to consider whether a child can be safely cared for within their extended family. Relatives who wish to be assessed should seek legal advice at an early stage to understand what assessments involve and how to present themselves as viable carers.
