RP Crawford & Co. Solicitor, Liam McDonald, recently acted on behalf of a Personal Injury client, SR, in a successful settlement in which SR was awarded £20,000.00.

Our client was a factory operative whose employment duties involved manual lifting amongst other things. On the day in question our client was lifting a large metal component with the assistance of another employee, whilst lifting our client gloves became snagged on another item. The work colleague was unaware of this and continue to move the metal component which resulted in our client sustaining a small fracture to the metacarpal in their left hand. He had very limited time off work and a small loss of earnings claim in the sum of £1,000.

We were able to successfully argue that the employer was liable as the actions of their employee (who was of course a colleague of our client) was negligent. It was further successfully argued that the employer did not employ a safe system of work or provide adequate protective clothing.

After obtaining expert medical evidence from an Accident and Emergency consultant and an Orthopaedic Surgeon we entered into negotiations and ultimately settled the case for £20,000. £1,000 for our client’s loss of earnings and £19,000 for their personal injury.
